In its final verdict, the 6th Magistrate’s Court of the MARSEILLE District Court sentenced the director of a limited liability company (SARL) which marketed replicas of weapons bearing counterfeit names of the following brands:
- COLT
- AK 47
- SMITH & WESSON
To the following punishment:
-  six months of incarceration in prison
- €87,217 of Customs fines

In addition, € 83,750 in damages and interest and reimbursement of the court costs were awarded to Cybergun S.A.  A court bailiff has been appointed to collect these sums.    

One should recall the provisions of article L716-9, which penalize acts of selling, supplying, or offering for sale goods bearing counterfeit brand names and impose a maximum punishment of 4 years in prison and a fine of € 400,000 plus Customs fines, whilst article 414 of the Customs Code provides for a maximum of three years in prison, confiscation of the goods and a fine of one to six times the value of the goods bearing counterfeit brand names.
